IMPORTANT NOTICE: PLEASE READ THESE TERMS CAREFULLY BEFORE USING THIS SITE.

This section outlines the terms of service of Eklipse services. Please read these Terms of Service and our Privacy Policy carefully before you access or use Eklipse services. By accessing or using Eklipse site and services, you agree to be bound by and abide by these Terms of Service. If you do not agree to any terms and conditions, you must not access or use the Website or our Services.

Description of Service

1. Our Services and Your Relationship with Us
Eklipse, (“Eklipse”, “we”, “us” or “our”) owns and operates the websites located at Eklipse (“Site”), where registered users (“users” or “you”) can have access to a variety of activities (“Service”), including to upload, download, generate, edit, display, browse, and share gaming video highlights (“Content”). These Terms of Service state the terms and conditions (“Terms”) that govern your use of the Site and the Service.

2. Acceptance of Terms

By accessing or using the Service you are agreeing that (i) you are 13 years of age or older, (ii) you comply with and be legally bound by these terms as well as our Privacy Policy and all applicable laws. If you disagree with any part of these Terms, you must discontinue the use of the Service and terminate your Account if you already registered.

You agree that for purposes of advertising dan marketing, all of your videos processed by Eklipse, Eklipse may use them at any time and in its sole discretion, including without limited, cut-ups, or trailers as “promotional assets”.

3. Your Account


Registration and Security

In order to use some features of the Service, you will have to sign up for an account with a username and a valid email address. You must provide true, accurate, current, and complete information and must ensure that this information is kept accurate and up-to-date at all times.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your device and/or account. You agree to accept responsibility for any activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You agree that we may access, preserve and disclose your account information and your Content if required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary to (a) comply with legal process; (b) enforce the Terms; (c) respond to a claim that your Content violates the rights of third parties; (d) respond if you contact us; or (e) protect the rights, property or personal safety of the Company, Users and the public.

Payment Security and Data Protection

Your payment data is protected using industry-standard encryption and security measures. We comply with all relevant data protection regulations to ensure your information remains secure.

4. Changes to these Terms

We may update these Terms occasionally to reflect changes in laws, regulations, industry standards, or enhancements to Eklipse and our services. When we make significant changes, we will provide you with advance notice. We encourage you to review these Terms regularly to stay updated on our policies. By continuing to use Eklipse after any updates, you accept the revised Terms. If you do not agree with the updated Terms, you must discontinue your use of our services.

5. Paid Service Terms

These Paid Services Terms apply to purchases such as Premium subscriptions or ProEdits services. By making a purchase, you agree to these terms and our acceptance policy.

Use of paid services

Eklipse utilizes third-party payment processors for handling transactions. By providing your payment details, you confirm that: (i) you are authorized to use the payment method provided; (ii) you will make payments for the services by the due date; (iii) the payment information you provide is accurate and true; (iv) we may store the payment information and method submitted by you and the payment issuer or network; and (v) we have your authorization to charge the payment method for the selected service. This includes any applicable taxes related to your purchase.

Additionally, you agree that we can retain and share your payment and purchase information with financial institutions and payment processors (both current and future) to process your transaction. We may also use your contact information, such as email or phone number, to send you notifications about renewals, recurring charges, and any updates related to your purchase.

Premium Plan and Additional Service

Certain Services are offered to you free of charge, while others require payment before access is granted, including the Eklipse Premium Plan and ProEdits Service. When you subscribe to the Eklipse Premium plan, you gain access to enhanced features, including but not limited to watermark removal, extended clip duration, and increased clip processing capacity.

Starting January 2024, we will introduce a new simplified subscription plan. We offer a Premium Plan option at $19.99 per month or $149.99 per year. Subscribers to this plan enjoy premium benefits which remain consistent whether on a monthly or annual basis. However, there are slight variations in credit allocation: monthly subscribers receive 600 minutes of YT Upload Credits monthly, while annual subscribers receive 7200 minutes upfront. To purchase or subscribe to any of our Premium Plans, you must first create an account on Eklipse and log in. Premium Plans are exclusively available to users of (i) the Google Android OS version with a valid Google account, or (ii) the Eklipse Web version with a valid Eklipse account.

If you purchase a subscription on our website, you will also receive Premium service on the mobile app version of Eklipse. Similarly, if you purchase a subscription through the Eklipse mobile app, you will have Premium service on the website version, as both platforms are synchronized. However, please note that any adjustments, changes, cancellations, upgrades, or downgrades to your plan must be made using the same device and payment method used for the original purchase.

We reserve the right to change our Premium and Additional Service including, by adjusting the features or services available or by adjusting pricing in any manner and at any time as we may determine in our sole and absolute discretion, which will not, without cause, affect the services and rights you have purchased and acquired under these Terms before such changes take effect.

Application of Premium Features

Please note: Upgrading to Eklipse Premium will not alter clips processed under the free plan. To access Premium features such as watermark removal, extended clip duration, voice commands, and additional clip highlights processed from a stream, you must resubmit your stream after subscribing to Premium. Only streams processed after activation of the Premium plan will benefit from these features.

Payment methods

To access our Premium Services, you can purchase or subscribe via your Apple ID, Google account, credit card, or PayPal powered by Braintree. This involves paying the necessary fees and taxes in your local currency. Failure to fulfill these payments may result in the suspension or termination of your access to Premium Services. All payments are to be made in United States dollars unless stated otherwise.

 

Details regarding Premium Plan pricing can be found on our website’s Premium Page or within the description pages of the Apple App Store and Google Play Store. If you’re using the Eklipse mobile app, subscriptions are processed through your Apple ID or Google account, adhering to the terms and conditions of the respective app stores. For Eklipse Web users, subscriptions will be processed through your credit card or PayPal account powered by Braintree, in accordance with our Terms, the terms of third-party payment service providers, and any additional payment terms.

Premium Lock-in Price

For all users Premium and Premium+ YouTube subscribers who have upgraded during our promotion period (Dec. 15 – Dec. 31, 2023), you receive the same benefits offered to new Premium members. Your current pricing will be maintained upon your next renewal. Monthly subscribers will receive 600 minutes per month, and annual subscribers will receive 7200 minutes upfront.

Please note: This upgrade will take effect in the next billing cycle for monthly subscriptions and will be active starting January 2nd for annual subscriptions. For more information, check out our help page.

Renewal
If you opt for the Premium Plan with automatic renewal, you acknowledge that (a) Apple, Google, and/or PayPal powered by Braintree (as applicable) may store and continue to bill your payment method (e.g., credit card) to ensure uninterrupted access to the Premium Plan, and (b) Apple, Google, and/or PayPal powered by Braintree (as applicable) may calculate taxes based on the billing details provided at the time of purchase. Except where mandated by the laws of your jurisdiction, we retain the right to modify our service or adjust pricing for the Premium Plan at our discretion. We will notify you of any such changes in advance. These alterations will not impact the services and rights you have already acquired under these Terms before the changes take effect, unless otherwise stated. Changes will not be immediately effective upon subscription renewal unless you explicitly consent. Specifically, price adjustments will not take effect immediately at the beginning of the subsequent subscription period following the price modification date. Therefore, please review any notifications regarding changes to the service carefully.

 

We will begin automatic billing on the date of your first subscription purchase (or upon successful payment method charge), and on each subsequent periodic renewal date (monthly, annually, or other renewal period) until cancellation. By making your initial subscription fee payment, you grant us authorization to continuously charge your payment method for recurring subscription fees. Please note that certain states and countries have mandatory laws that govern cancellation rights, which may supersede the provisions of this paragraph. You acknowledge that your subscription will automatically renew, and you authorize us to charge your payment method for the subscription fee and any applicable taxes on each periodic renewal date.

Cancellation and Adjust Plan

To discontinue recurring charges, you must cancel your subscription via the account you used when you subscribed, whether it is your Apple ID, Google account, or the Eklipse website if purchased using PayPal powered by Braintree (as applicable) before the current subscription period ends. Further details on canceling your subscription can be found in our Refund Policy within the Terms of Use. If you cancel, you will retain access to the Premium Plan until the current subscription period concludes. Upon the effective date of cancellation at the conclusion of the current subscription period, your subscription will be downgraded to the Free Plan.

 

If you want to change your payment processor from one to another, you must first cancel your subscription with your current payment processor and then purchase again using your new preferred payment processor.

 

When purchasing a new plan or modifying an existing one, the previous plan will be terminated, and any remaining credits will be transferred to the new plan.

Please be aware that any remaining credits from the previous plan will expire within 60 days for monthly plans and 13 months for annual plans. Upon renewal with the new plan, these remaining credits will be refreshed with a new expiration date and an updated credit limit. This policy applies to both monthly and annual subscriptions.

Changing Payment Method

Users can change their payment method directly through their payment processor. For example, you can update your payment method from one credit card to a new credit card that is still supported by Braintree (a PayPal service), or switch from Apple Pay to another payment method supported by the App Store. However, transitioning your payment method between different payment processors (e.g., moving from Apple Pay to Google Pay) directly through Eklipse is not possible. In such cases, you will need to cancel your current subscription and purchase a new plan using your preferred payment method.

Note for Existing Subscribers: If you are an existing user subscribed to an old Eklipse plan with a locked price, you will need to purchase a new plan at the current rate if you wish to continue subscribing after changing your payment method.

Trial and Offer Regulations

Any trial or promotional offer for Eklipse’s premium subscription, including discounts applied using a promo code at checkout, will be clearly stated in the respective offer details. Please review the specifics of each offer carefully, as the duration and terms may vary.

 

Discounts are applied only to the first purchase and do not extend to subsequent renewals. For monthly plans, the discounted rate applies only to the first month; subsequent months will be billed at the standard rate. For annual plans, the discount applies only to the first transaction, with subsequent renewals charged at the regular price for the following year.

 

Promotions cannot be redeemed or combined with any other offers or discounts. Only one promotional offer may be applied per transaction.

 

Promotions are valid only within the specified time limit. Claims for promotional offers must be made within the designated period as outlined in the respective offer details.

Account Deletion and Subscription Management

Should you wish to delete your Eklipse account or uninstall Eklipse mobile application, it is imperative that you first cancel any ongoing subscriptions on Eklipse.

Please note that if you delete your Eklipse account, your associated Premium subscription linked to that account will be lost. However, in exceptional cases of service failure, you may contact our customer support team to request a restoration of your Premium purchase without a refund.

Regarding the deletion or uninstallation of the mobile application, please be aware that removing the application will not automatically cancel your ongoing subscription plan. Your Eklipse account will remain active, and your Premium subscription will continue uninterrupted. The responsibility for managing your subscription, including renewal, will continue to rest with you
